1. Scope

This Campaign Creator Agreement (“Agreement”) applies to all users who create or manage fundraising campaigns (“Creators”) on Upfoundly.

2. Eligibility

By creating a campaign, you confirm that:

• You are at least 18 years of age;
• You have legal authority to represent any organization you list;
• You are not barred from using such services under applicable law.

3. Accuracy and Honesty

You agree that:

• All information in your campaign is truthful, accurate, and not misleading;
• You will update your campaign promptly if circumstances change;
• You will not omit material facts that would affect a donor’s decision.

4. Use of Funds

You must use all funds received exclusively for the purposes stated in your campaign page. Misuse of funds may result in:

• Campaign suspension or removal;
• Frozen or reversed payouts where permitted by law;
• Permanent account closure;
• Referral to law enforcement where required.

5. Rewards and Obligations

If you offer rewards, perks, or other benefits, you are solely responsible for their production, delivery, and any associated costs, taxes, or customs duties.

6. Compliance with Laws

You are responsible for complying with all applicable laws and regulations, including but not limited to fundraising, consumer protection, tax, and charity regulations in your jurisdiction.

7. Verification and Documentation

You agree to provide any documentation reasonably requested by Upfoundly to verify your identity, organizational status, or campaign legitimacy. Failure to do so may result in suspension or termination of your campaign.

8. Fees

You agree to the applicable platform and payment processing fees disclosed by Upfoundly. Fees may change from time to time, and updated fees will be published on the Platform.

9. Prohibited Campaigns

You agree not to create campaigns that involve or support illegal, fraudulent, hateful, extremist, or otherwise prohibited activities as defined in our Acceptable Use Policy.

10. Indemnity

You agree to indemnify and hold harmless Upfoundly from any claim, loss, or damage arising out of or related to your campaign, including misuse of funds, failure to deliver rewards, or violation of law.

11. Relationship with Donors

The legal relationship in respect of donations is between you and your donors. Upfoundly is not a party to that relationship and is not responsible for your promises, statements, or obligations to donors.

12. Termination

Upfoundly may suspend or terminate your campaign or account at any time if it reasonably believes that you have violated this Agreement, the Terms of Service, or applicable law.

13. Acceptance

By clicking “Create Campaign”, you confirm that you have read, understood, and agree to this Campaign Creator Agreement and the Terms of Service.
